Acceptance of terms
By accessing or using the Peekator platform, website, applications and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Services.
These Terms constitute a legally binding agreement between you (or the organisation you represent) and Peekator Ltd ("Peekator", "we", "us"). If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
We may update these Terms from time to time. Your continued use of the Services after any changes indicates your acceptance of the revised Terms.
Eligibility and accounts
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. By creating an account, you confirm that you meet these requirements.
Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use or security breach.
Account information
You agree to provide accurate, current and complete information when creating and maintaining your account. We reserve the right to suspend or terminate accounts with inaccurate or misleading information.
Platform access
Subject to your compliance with these Terms, Peekator grants you a limited, non-exclusive, non-transferable licence to access and use the Services for your internal research and business purposes.
You may not:
- Reproduce, duplicate, copy, sell or resell any part of the Services.
- Use the Services in any way that could damage, disable or impair them.
- Attempt to gain unauthorised access to any part of the Services or related systems.
- Use automated means (including bots, scrapers or spiders) to access the Services without our prior written consent.
- Circumvent any access controls or security measures.
Subscription and pricing
Access to the Services is provided under subscription plans, custom enterprise agreements, or project-based contracts, as described on our Pricing page or in a separately executed agreement. Fees are quoted exclusive of applicable taxes unless otherwise stated.
Billing
Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). You authorise us to charge your designated payment method for all applicable fees.
Refunds and cancellations
You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period. Fees are non-refundable except where required by law or as otherwise agreed in writing.
Changes to pricing
We may change our fees upon reasonable notice. If you do not agree to a fee change, you may cancel your subscription before the change takes effect.
Customer responsibilities
You are solely responsible for:
- Obtaining all necessary consents, permissions and legal rights to collect and process respondent data through the Services.
- Ensuring your use of the Services complies with all applicable laws, regulations and industry standards.
- The content of surveys, discussion guides, interview prompts and any other materials you create or upload.
- Ensuring respondent communications (including invitations and reminders) are accurate, lawful and not misleading.
- Maintaining appropriate privacy notices and data processing agreements with your respondents.
You may not use the Services to collect or process sensitive personal data (as defined under applicable data protection law) without our prior written consent and appropriate safeguards in place.
Research data and content
You retain all ownership rights in the research data, survey responses, interview transcripts, uploaded files and other content you create, collect or store using the Services ("Customer Content").
Licence to Peekator
You grant Peekator a limited licence to access, process and store Customer Content solely for the purpose of providing, maintaining and improving the Services. This licence terminates when you delete the applicable content or close your account.
Data deletion
You may delete Customer Content at any time. Upon deletion, we will remove the content from active systems within a reasonable period, though it may persist in encrypted backups for up to 30 days or as required by law.
AI features
Peekator provides AI-powered features including AI interviews, automated analysis, theme extraction, summary generation and sentiment classification ("AI Features"). These features are provided to assist research workflows and should not be relied upon as the sole basis for business or legal decisions.
Accuracy and review
AI-generated outputs (including transcripts, summaries, themes and insights) may contain errors, omissions or inaccuracies. You agree to review and validate all AI-generated content before relying on it for research conclusions or business decisions.
AI sub-processors
AI Features may rely on third-party language models and AI providers acting as sub-processors. Customer Content sent to these providers is processed under contractual confidentiality obligations and is not used to train foundation models.
Fair use
AI Features are subject to fair use limits based on your subscription plan. Excessive or abusive use may result in throttling or temporary suspension of AI functionality.
Intellectual property
Peekator and its licensors retain all rights, title and interest in and to the Services, including all software, code, designs, trademarks, logos and documentation. These Terms do not grant you any right, title or interest in Peekator's intellectual property.
Feedback
Any feedback, suggestions or ideas you provide about the Services may be used by Peekator without restriction or obligation to you.
Confidentiality
Peekator treats Customer Content and all non-public information disclosed in connection with the Services as confidential. We implement appropriate technical and organisational safeguards to protect this information from unauthorised access, disclosure or use.
Our personnel access Customer Content only when necessary to provide support, maintain security, comply with legal obligations or as otherwise authorised by you. All staff with access to Customer Content are bound by confidentiality obligations.
Service availability
We use commercially reasonable efforts to make the Services available with minimal interruption. However, the Services may be unavailable from time to time for scheduled maintenance, unplanned outages or events beyond our reasonable control.
We do not guarantee that the Services will be uninterrupted, timely, secure or error-free. Your sole remedy for service unavailability is a credit or refund of fees paid for the affected period, at our discretion.
Limitation of liability
To the fullest extent permitted by applicable law, Peekator and its officers, employees, agents and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of the Services.
Our total cumulative liability to you for any claims arising under or in connection with these Terms shall not exceed the total amount paid by you to Peekator in the 12 months preceding the claim, or GBP 100, whichever is greater.
Nothing in these Terms limits or excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
Termination
By you
You may stop using the Services and cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
By us
We may suspend or terminate your access to the Services with reasonable notice if you breach these Terms, fail to pay fees when due, or if required by law. In cases of serious breach, we may terminate immediately.
Effect of termination
Upon termination, your right to use the Services ceases immediately. We will retain Customer Content for a reasonable period to allow you to export your data, after which it may be deleted in accordance with our data retention policies.
Changes to these terms
We may modify these Terms at any time. We will provide reasonable notice of material changes by posting the updated Terms on our website, sending an email notification, or displaying a notice within the Services.
Your continued use of the Services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.
